Will Preparation Under Ontario Law

In Ontario, wills and estate documents are governed primarily by the Succession Law Reform Act (R.S.O. 1990, c. S.26). Every document prepared through Wills Made Easy is drafted in full compliance with Ontario law by a licensed Ontario legal professional.

Ontario uses different terminology than most other provinces for its power of attorney documents. There are two entirely separate instruments: a Continuing Power of Attorney for Property — which authorizes your chosen person to manage your financial and legal affairs — and a Power of Attorney for Personal Care, which covers healthcare and personal decisions. Both are governed by Ontario's Substitutes Decisions Act, 1992.

The word “Continuing” in the property POA is legally significant — it signals that the document remains valid even if the grantor loses mental capacity. A standard Power of Attorney in Ontario becomes void upon incapacity. Ensuring your documents use the correct form and language is essential, and it's one reason professional preparation matters.

Ontario also has one of Canada's most detailed dependent support obligations under the Succession Law Reform Act. If a person dies without adequately providing for a spouse, child, or other dependant, a court can order support payments from the estate regardless of what the will says. A professionally prepared will addresses these obligations proactively.

Ontario is also the only province in Canada with a formal Certificate of Appointment of Estate Trustee (formerly called Probate) process that applies to nearly all estates. While the will itself does not require probate to be valid, executors dealing with financial institutions will almost always need it — which is another reason having a properly witnessed and executed will reduces friction for your family.
