In Newfoundland and Labrador, wills are governed by the Wills Act (R.S.N.L. 1990, c. W-10). Every document prepared through Wills Made Easy is drafted in full compliance with NL law by a licensed legal professional.
Newfoundland and Labrador uses the term Advance Health Care Directive — consistent with New Brunswick — governed by the Advance Health Care Directives Act, 2022. This relatively recent legislation modernized the province's approach to healthcare decision-making, explicitly recognizing the right to make health care decisions in advance and appoint a Substitute Decision Maker. The 2022 Act strengthened personal autonomy provisions and clarified the obligations of healthcare providers when a directive is in place.
Your Enduring Power of Attorney in NL is governed by the Powers of Attorney Act. The enduring form is the only version that survives mental incapacity. In Newfoundland and Labrador, if no valid Enduring POA exists at the time of incapacity, a family member must apply for a committee — a court-appointed role under the Mental Health Care and Treatment Act — which can be a slow and expensive process.
Estates in NL pass through the Newfoundland and Labrador Supreme Court probate process. A properly drafted will with a named executor and clear instructions significantly reduces the time and cost of probate for your family.
Under NL's intestacy rules, common-law partners do not automatically inherit — the estate passes to blood relatives.
