By accessing or using the WillsMadeEasy.ca website and services (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
Description of Service
WillsMadeEasy.ca is an online platform that facilitates the preparation and drafting of will documents by connecting clients with qualified lawyers across Canada.
Important: WillsMadeEasy.ca is not a law firm and does not provide legal advice. We are a technology platform that simplifies the process of connecting you with a licensed legal professional. The lawyer assigned to your file is responsible for providing legal services and ensuring your will meets all applicable legal requirements.
Eligibility
To use our Service, you must:
- Be at least 18 years of age
- Be a resident of Canada
- Have the legal capacity to enter into a binding agreement
- Provide accurate and complete information when using our Service
User Responsibilities
By using our Service, you agree to:
- Provide accurate, current, and complete information as required
- Keep your account credentials confidential
- Not use the Service for any unlawful purpose
- Not attempt to interfere with or disrupt the Service or its servers
- Not impersonate any person or entity
- Comply with all applicable Canadian federal and provincial laws
Payment & Refunds
Our fees are displayed clearly on our Pricing page before you complete your purchase. By submitting payment, you authorize us to charge the applicable fee to your chosen payment method.
All payments are processed securely through our third-party payment provider. We do not store your full payment card details.
Refunds are handled on a case-by-case basis. If you are unsatisfied with our Service, please contact us at info@willsmadeeasy.ca and we will work with you to find a reasonable resolution.
Intellectual Property
All content on the WillsMadeEasy.ca website — including text, graphics, logos, and software — is the property of WillsMadeEasy.ca and is protected by applicable Canadian copyright and intellectual property laws.
You may not reproduce, distribute, or create derivative works from our content without our express written permission.
The will documents prepared on your behalf through our Service are yours. We do not claim ownership of the personal documents created for you.
Disclaimers & Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
WillsMadeEasy.ca is not responsible for:
- The legal accuracy or enforceability of any will document prepared through our platform — this is the responsibility of the assigned lawyer
- Any errors resulting from inaccurate information provided by the user
- Indirect, incidental, or consequential damages arising from use of the Service
- Service interruptions, technical errors, or data loss
To the maximum extent permitted by Canadian law, our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid for the Service.
Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nova Scotia.
Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other legitimate business reason.
You may also discontinue use of the Service at any time by contacting us to close your account.

For Legal Professionals
Terms for Lawyer Partners
The following terms apply specifically to licensed legal professionals who partner with Wills Made Easy to deliver will-drafting services to clients. These terms supplement the General Terms above and govern your relationship with WillsMadeEasy.ca as a service partner.
1. Partner Relationship
By applying to and being accepted as a Wills Made Easy lawyer partner, you enter into a non-exclusive service partnership with WillsMadeEasy.ca. This partnership does not create an employment relationship, agency, joint venture, or franchise. You remain an independent legal professional, fully responsible for your own practice, compliance, and professional obligations.
Acceptance into the WME network is at the sole discretion of WillsMadeEasy.ca. We reserve the right to limit the number of lawyers in any given city or region for capacity and quality management purposes.
2. Professional Standards & Obligations
As a WME lawyer partner, you agree to:
- Maintain a valid licence to practice law in your province in good standing with your provincial law society
- Carry adequate professional liability (errors & omissions) insurance at all times
- Prepare, review, witness, and notarize all client documents in full compliance with the laws of the applicable province
- Conduct yourself professionally and courteously in all client interactions
- Respond to client appointments within the timeframes established in your partnership agreement
- Promptly notify WillsMadeEasy.ca of any changes to your licence status, insurance coverage, or professional standing
3. Scope of Services
Through the WME platform, you agree to provide clients with the following documents at each appointment:
- Legal Will
- Enduring Power of Attorney
- Healthcare Directive
- Guardian Appointment (where applicable)
All documents must be signed, witnessed, and notarized at the appointment. You are responsible for the legal accuracy and enforceability of all documents you prepare. WillsMadeEasy.ca provides the platform, client intake, and document preparation tools — legal responsibility rests solely with you as the licensed professional.
4. Revenue Share & Payment
Revenue share rates, payment schedules, and fee structures are set out in your individual Partnership Agreement with WillsMadeEasy.ca. In the absence of a signed Partnership Agreement, no compensation is owed.
WillsMadeEasy.ca collects payment from clients directly and remits your share according to the schedule in your Partnership Agreement. You agree not to collect additional fees from WME clients for services included in the WME package without prior written consent from WillsMadeEasy.ca.
5. Use of the WME Platform & Brand
You are granted a limited, non-exclusive, non-transferable licence to use the WME platform and brand assets solely for the purpose of delivering services to WME clients. You may not:
- Represent yourself as an employee or owner of WillsMadeEasy.ca
- Use the WME name, logo, or brand in any way that could cause confusion about the nature of your role
- Solicit WME clients for services outside the WME platform without prior written consent
- Share platform access credentials with any third party
6. Client Data & Confidentiality
All client information shared with you through the WME platform is strictly confidential. You agree to:
- Use client data solely for the purpose of delivering WME services
- Not store, copy, or use client data outside of what is required for document preparation
- Comply with all applicable Canadian privacy legislation, including PIPEDA and applicable provincial privacy laws
- Immediately notify WillsMadeEasy.ca of any suspected or actual data breach involving WME client information
Solicitor-client privilege applies to your communications with clients. Nothing in these terms limits your professional confidentiality obligations under your law society’s rules of professional conduct.
7. Intellectual Property
The WME platform, templates, intake forms, branding, and related materials are the exclusive intellectual property of WillsMadeEasy.ca. Your use of these materials does not grant you any ownership interest.
The completed legal documents you prepare for clients belong to the client. WillsMadeEasy.ca claims no ownership over individual client documents.
8. Term & Termination
Your partnership with WillsMadeEasy.ca continues until terminated by either party. Either party may terminate the partnership with 30 days’ written notice. WillsMadeEasy.ca may terminate immediately and without notice if you:
- Lose your licence to practice law or are suspended by your law society
- Are found to have committed professional misconduct
- Breach any material term of these Terms or your Partnership Agreement
- Engage in conduct that damages or risks damage to the WME brand or its clients
Upon termination, your access to the WME platform will be revoked. Outstanding revenue share owed for completed appointments will be remitted according to the normal payment schedule.
9. Liability & Indemnification
WillsMadeEasy.ca is not responsible for any legal malpractice, errors, or omissions in documents you prepare. You agree to indemnify and hold harmless WillsMadeEasy.ca, its directors, officers, and employees from any claims, damages, or costs arising from your provision of legal services to WME clients.
WillsMadeEasy.ca’s total liability to you for any claim arising from the partnership shall not exceed the revenue share paid to you in the 60 days preceding the claim.
10. Governing Law
These lawyer partner terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nova Scotia.
